一、適用範圍

本程序參照美國《數位千禧年著作權法》（DMCA）第512條所建立之通知與移除架構運作，供境外權利人循此提出請求。

若您依據中華民國《著作權法》第九十條之四以下規定主張權利，請改參閱本站著作權政策，兩者受理信箱相同，程序要件略有差異。

二、送件前請先確認

您是該著作之權利人，或已取得權利人授權代為行使。

您已實際檢視爭議內容，並非僅憑第三方轉述或搜尋結果推測。

該使用情形未落入合理使用、授權範圍或其他法定阻卻事由。

三、通知書應具備之六項要件

請於信件中逐項載明，任一項缺漏都會延後處理：

要件不全時，本站會去信請求補件，處理時程自補正齊備之日起算。

四、收件後的處置

通知經核對符合前條要件者，本站將移除該內容或中止其對外存取。

技術上可行時，會一併知會原上傳者其內容遭移除之事實與依據，使其得以判斷是否提出異議。

移除係為履行法定免責要件所為之行政處置，不代表本站已認定侵權成立，亦不影響雙方後續之法律主張。

五、原上傳者之異議（Counter-Notification）

若您認為內容遭誤判而被移除，得依第512(g)條寄送異議書至 [email protected]，並載明：

異議書符合要件者，本站得轉知原通知人。原通知人若未於法定期間內循司法途徑處理，本站得回復原內容或恢復其存取。

六、累犯之處置

對於經多次有效通知確認之重複侵權使用者，本站得停用其既有連結、限制其上傳權限、封鎖來源 IP，或終止其使用本服務。

七、不實陳述之風險

依第512(f)條，明知不實仍就「內容構成侵權」或「內容遭誤刪」為重大不實陳述，致他人受損害者，須負損害賠償責任。送件前請審慎查證。

八、紀錄保存與機關協力

本站雖採免註冊上傳，惟系統會留存連線 IP、時間戳記與存取軌跡，供維運、資安與法遵之用。

接獲合法令狀或公文書時，本站將依規定提供上開紀錄。

九、其他類型之違法內容

若欲檢舉之標的屬未經同意散布之性私密影像、兒少性影像或其他刑事違法內容，請改循性私密影像與違法內容處理政策之緊急管道，該類案件享有優先處理順位。

1. Scope

This procedure follows the notice-and-removal framework set out in Section 512 of the U.S. Digital Millennium Copyright Act (DMCA) and is available to overseas rights holders. Where a claim is brought under Articles 90-4 and following of the Copyright Act of the Republic of China (Taiwan), please refer instead to our Copyright Policy; the receiving mailbox is the same, though the formal requirements differ slightly. MyPPT supplies short-link and file-hosting technology only; material is uploaded by users without prior review by the platform.

2. Before You File

Please confirm that you own the work or are authorised to act for the owner, that you have actually inspected the disputed item rather than relying on a third-party description or a search result, and that the use does not fall within fair use, a licence, or any other lawful exception.

3. Six Elements the Notice Must Contain

State each item explicitly; any omission delays handling: ① the signature of the owner or agent, handwritten or electronic; ② specific identification of the infringed work, listed individually if several are involved; ③ the complete short URL on this Site, sufficient for us to locate the item; ④ contact details — name, address, telephone, email; ⑤ a statement of your good-faith belief that the use is not permitted by the owner, its agent, or the law; and ⑥ a statement that the information is accurate and, under penalty of perjury, that you are entitled to file the notice. Incomplete notices trigger a request for supplementation, and the handling clock restarts once complete.

4. What Happens Next

Once a notice is verified as compliant, the item is removed or its public access is suspended. Where technically feasible, the uploader is informed of the removal and its basis so that they can decide whether to object. Removal is an administrative step taken to satisfy statutory safe-harbour conditions; it is not a finding of infringement and does not prejudice either party's legal position.

5. Counter-Notification by the Uploader

An uploader who believes the removal was mistaken may send a counter-notice under Section 512(g) to [email protected] stating: ① their signature; ② identification of the removed item and the short URL where it previously appeared; ③ a statement under penalty of perjury of a good-faith belief that removal resulted from mistake or misidentification; and ④ name, address, telephone number, consent to the jurisdiction of the competent court, and acceptance of service from the original notifier. A compliant counter-notice may be forwarded to the notifier; if no legal proceedings follow within the statutory period, the content may be restored.

6. Repeat Offenders

Users confirmed through repeated valid notices may have existing links disabled, upload rights restricted, source IP addresses blocked, or their use of the service terminated.

7. Consequences of False Statements

Under Section 512(f), a knowing material misrepresentation that content is infringing, or that it was wrongly removed, gives rise to liability for resulting damages. Verify carefully before filing.

8. Records and Cooperation with Authorities

Although uploading requires no account, connection IP addresses, timestamps, and access traces are retained for operations, security, and legal compliance, and are supplied when a lawful order or official document is received.

9. Other Categories of Unlawful Material

Reports concerning non-consensual intimate images, child sexual abuse material, or other criminal content should instead use the urgent channel in the NCII & Illegal Content Policy, where such cases receive processing priority.
